TERMS & CONDITIONS
By placing an order with Premier Water Tanks LLC (“Premier Water Tanks,” “we,” “us,” or “our”), the customer (“Customer”) agrees to the following Terms & Conditions.
ORDERS & ACCEPTANCE
All orders are subject to acceptance by Premier Water Tanks LLC. We reserve the right to refuse or cancel any order at our discretion, including but not limited to pricing errors, product availability, or customer credit concerns. Special-order or non-stock items may not be cancellable once the order has been placed.
PRICING & PAYMENT
All prices are subject to change without notice. Payment terms are as stated on the invoice or sales agreement. Orders may be delayed or canceled if payment is not received in accordance with agreed terms. Taxes, freight, and additional fees are the responsibility of the Customer unless otherwise stated in writing.
SHIPPING & DELIVERY
Shipping dates provided are estimates only. Premier Water Tanks LLC is not responsible for delays caused by carriers, weather, supply chain disruptions, acts of God, labor shortages, material availability, governmental actions, or other circumstances beyond our control. Shipping delays do not constitute grounds for order cancellation, refusal, or damages. Shipping costs are not included in the prices of any items. Order will not be filled on weekends or National holidays unless stated otherwise. While our goal is always same day fulfillment, please allow 1-3 days for processing.
NO SHIPPING TO P.O. BOXES:
Premier Water Tanks LLC does not ship to P.O. Boxes. Our products are shipped via commercial carriers, freight companies, or LTL transport that require a physical delivery address for scheduling, unloading, and proof of delivery. P.O. Boxes cannot accommodate oversized freight, hazardous materials, or carrier delivery requirements and are therefore not accepted.
FREIGHT & SHIPPING DAMAGE
All shipments must be inspected by the Customer at the time of delivery. Any visible damage must be clearly noted on the carrier’s delivery receipt before signing. Concealed damage must be reported to the carrier and to Premier Water Tanks LLC within 48 hours of delivery.
Failure to properly note damage or report claims within required timeframes may result in denial of freight damage claims. Premier Water Tanks LLC is not responsible for damage occurring in transit once the shipment has been released to the carrier, except as required by applicable law.
RISK OF LOSS
Risk of loss transfers to the Customer upon delivery to the carrier unless otherwise stated in writing. The Customer is responsible for proper unloading, handling, and storage after delivery.
RETURNS & RESTOCKING
Returns are subject to prior authorization. Returned items must be unused, uninstalled, and in original condition. Special-order, custom, or non-stock items are non-returnable. Restocking fees may apply. Freight charges are non-refundable.
WARRANTY
Warranty coverage is governed by Premier Water Tanks LLC’s published Parts Warranty and Tank Warranty policies. No other warranties, express or implied, are provided unless expressly stated in writing. Labor, freight, removal, reinstallation, downtime, and consequential damages are not covered unless authorized in advance.
LIMITATION OF LIABILITY
Premier Water Tanks LLC shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of profits, or business interruption, even if advised of the possibility of such damages. Liability, if any, is limited to the purchase price of the product giving rise to the claim.
FORCE MAJEURE
Premier Water Tanks LLC shall not be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, acts of God, labor disputes, material shortages, transportation disruptions, or governmental actions.
GOVERNING LAW
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
ENTIRE AGREEMENT
These Terms & Conditions, together with applicable warranties and written agreements, constitute the entire agreement between the parties and supersede all prior representations or agreements.
